GENERAL CONDITIONS OF SALE

1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

1.1 - The Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the general and payment conditions transcribed below.

1.2 - The Customer keeps these general conditions of sale, in compliance with the provisions of art. 50 and following of Legislative Decree 206/05.

1.3 - Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things.

2. PURCHASE METHOD

2.1 - The Customer can only purchase the products present in the electronic catalog of the website www.espressokamira.com at the time of placing the order, as present  in their descriptions. It is understood that the image accompanying the description of each product may not be perfectly representative of its characteristics but differ in color tones, dimensions, accessory products shown in the figure.

2.2 - The correct receipt of the order is confirmed by Kamira SRL by an e-mail reply, sent to the e-mail address communicated by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, using the customer service.

2.3 - In case of non-acceptance of the order Kamira SRL guarantees timely communication to the Customer.  

 

3. METHOD OF PAYMENT

3.1 - Credit card: in cases of purchase of goods with a credit card payment method, the credit card will be charged at the same time as the order is processed.

3.2 - Kamira SRL reserves the right to request additional information from the Customer (e.g. telephone number, e-mail address) or to send copies of documents proving ownership of the Card used. In the absence of the required documentation, Kamira has the right not to accept the order.

3.3 - At no time during the purchase procedure Kamira SRL is able to know the information relating to the buyer's credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction. Kamira, can keep such data only upon explicit request and / or consent of the customer: in this case Kamira guarantees that such data are stored according to certified security standards and that they are always displayed in masked mode.

3.4 - Bank transfer: the details to be able to make the payment will be sent in the order confirmation e-mail, the goods are shipped only after receiving  the crediting of the sum sent.

3.5 - Cash on delivery: in case of purchase on delivery, an additional contribution will be applied to the total amount, clearly highlighted when choosing the payment method. Payment, to be made directly to the courier, will be made upon delivery of the products. It is possible to pay only in cash, it is not possible to pay by check.

3.6 - Purchases via PayPal: in cases of purchase of goods with PayPal payment methods, at the same time as the online transaction is concluded, PayPal will immediately charge the amount relating to the purchase made.  

 

4. METHOD AND DELIVERY COSTS

4.1 - For each order placed on the website www.espressokamira.com, Kamira SRL issues a receipt or receipt for the material shipped. For  the issuance of the invoice will be authenticated by the information provided by the Customer at the time of the order. After the invoice has been issued, it will not be possible to make changes to it.

4.2 - Delivery costs, if any, are charged to the Customer and are clearly stated when placing the order. Nothing more is due since

Customer with respect to the total order.

4.3 - No responsibility can be attributed to Kamira SRL in case of delay due to unforeseen and / or unforeseeable events.

4.4 - The delivery of what is ordered means at street level.

Upon delivery of the goods by the courier, the Customer is required to check:

- that the packaging is intact, not damaged or otherwise altered, even in the closing materials (adhesive tape or strapping).

- any damage to the packaging and / or the product or the mismatch in the number of packages must be immediately reported, by affixing  WRITTEN CHECK RESERVE (SPECIFYING THE REASON FOR THE RESERVE, eg "laundry package", "crushed package", etc.) on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery.

4.5 - In case of non-collection within 5 working days of the material present in storage at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be returned to the Kamira warehouses SRL.  The customer undertakes to pay the cost of the "STOCK" created at the courier's depot in the event that the stock was generated for reasons due to his own responsibility. 

4.6 - In case of refusal (at the time of delivery) of the product requested by "cash on delivery" method, the ordering customer undertakes to pay the costs incurred by KAMIRA for sending and returning the product to the premises, including ancillary costs (preparation, labels, packaging), the customer also undertakes to pay Kamira the value of any indelible engraving requested on the boiler.

 

5. RIGHT OF WITHDRAWAL

5.1 - Pursuant to art. 64 and following of Legislative Decree 206/05, if the customer is a final consumer, he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations. If the customer is a company or a reseller who buys for business reasons, he does not have this right.

5.2 - To exercise this right, the customer within 14 working days from the date of receipt of the goods must send a written communication also via e-mail declaring that he wishes to exercise the right of withdrawal to:

As soon as the request is received  of "withdrawal" kamira will send the courier (if requested by the customer) for collection at the address indicated by the customer who will receive advance notice from the courier. Within 3 working days from the return of the goods to your warehouse  kamira will re-credit the amount after verifying the full return of the product sold, it will be the customer's responsibility to promptly provide the details on which to obtain the refund. The costs incurred by kamira srl for shipping will be deducted from the reimbursement.

The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packaging), kept and possibly used according to normal diligence, without any signs of wear or dirt.

5.3 - The right of withdrawal is however subject to the following conditions:

- the law applies to products purchased in their entirety; it is not possible to exercise withdrawal only on part of the products purchased;

- the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc ...); to limit damage to the original packaging, we recommend inserting it in a second box, on which to affix the label with the address of the recipient, in all cases the affixing of labels or adhesive tapes directly on the original product packaging should be avoided;

- in case of purchase with cash on delivery, Kamira SRL will deduct from the refund the amount intended for the courier for handling the money (published on the site as "cash on delivery payment costs").

5.4 - The right of withdrawal is totally lost if everything received (manuals, parts, etc ... including the purchase receipt) is not returned. 

In case of forfeiture of the right of withdrawal, the goods will remain at the Kamira headquarters, available to the Customer for collection at his expense. 

5.5 - The right of withdrawal is excluded in the following cases:

  • audio-visual products, sealed computer software, once opened after delivery (including those attached to hardware material);

  • tailor-made or clearly personalized products;

  • products that risk deteriorating or expiring rapidly;

  • sanitary articles, medical devices and electro-medical equipment, food supplements or slimming products and / or parapharmaceutical and similar products;

  • sealed products that cannot be returned for hygienic reasons or related to health protection, once opened after delivery (such as, by way of example only, cosmetic products, perfumes, beauty creams, herbal items, etc.).

  • in general, in all other cases provided for by art. 59 of the Consumer Code, or which are completely outside the scope of the same pursuant to art. 47 of the Consumer Code.

Any limitations to the right of withdrawal may be highlighted in the Order form being filled in by the Customer.

6. WARRANTIES

  Kamira SRL provides the manufacturer's conventional warranty of 24 months for lack of conformity. To use the warranty, the customer must keep the tax document sent to him.

6.1 - The warranty can be extended to 60 months with an advanced request by calling 331 3217731 within 15 days of purchase, during the phone call one of our technicians will give the customer useful information for the correct use of the kamira and for obtaining the type of desired espresso.  This guarantee is reserved for the private consumer (natural person who buys the goods for purposes not related to professional activity.  In case of lack of conformity, Kamira provides, at no cost to the customer, to restore the conformity of the product by repairing / replacing the purchased product.

6.2 - In the event that, for any reason, kamira is unable to replace the product, it may proceed at its discretion to refund the total amount paid. 

6.3 - The shipping costs for the intervention covered by the guarantee are always charged to the customer.  

 

7. PRIVACY

7.1 - The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer. Kamira SRL guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree no. 196 of 30.06.03. The release of the e-mail address authorizes kamira to use it in order to periodically inform its customers about news, promotions and useful information for consumers. If the customer does not wish to receive promotions via email, he can freely and independently deactivate the service in the personal area by logging in (registration email and password).

The data controller is Kamira SRL.

7.2 - Applicable law The sales contract between the customer and Kamira SRL. it is understood to be concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the competence. territorial is that of the reference forum of his / her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Messina Forum.
